These Terms of Service (“Terms”) govern your use of the AI Emergency Preparedness Plan service (“Service”) operated by Prepared Hero (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description
The AI Emergency Preparedness Plan is a digital product that generates personalized emergency preparedness plans based on information you provide about your household, family, and location. Plans are generated using artificial intelligence and publicly available risk data.
Important:
Our plans are informational tools designed to help you prepare for emergencies. They are not a substitute for professional emergency services, medical advice, or official government emergency guidance. In an emergency, always call 911 or your local emergency number first.
2. Eligibility
You must be at least 18 years old to purchase or use the Service. By using the Service, you represent that you are at least 18 years of age and have the legal authority to enter into these Terms.
3. Purchases & Pricing
- Free Assessment: Available at no cost. Provides a risk score and threat overview for your address.
- Family Safety Plan: A one-time purchase that generates your complete personalized emergency plan as a downloadable PDF.
- Prepared Plan+: A recurring subscription that provides quarterly plan updates, alerts, and ongoing monitoring. Billed every 3 months or annually.
- All prices are listed in US dollars and are subject to change. Any price changes will not affect existing paid orders.
- Payment is processed securely by Stripe. We do not store your credit card information.
4. Subscriptions & Cancellation
- Prepared Plan+ subscriptions renew automatically at the end of each billing period unless cancelled.
- You may cancel your subscription at any time from your account dashboard or by contacting support.
- Upon cancellation, you retain access through the end of your current billing period. No partial refunds are issued for unused time.
- Your one-time Family Safety Plan PDF remains yours permanently, regardless of subscription status.
5. Refund Policy
Because the Family Safety Plan is a digital product generated specifically for your household, all sales are final once your plan has been generated and delivered. If you experience a technical issue that prevents you from receiving your plan, contact us at support and we will resolve the issue or issue a refund at our discretion.
6. Accuracy & Limitations
- Plans are generated using AI technology and publicly available data from sources such as FEMA, NOAA, and FBI UCR. While we strive for accuracy, we do not guarantee the completeness or accuracy of all generated content.
- Risk assessments are based on historical data and publicly available information. Actual emergency conditions may differ from projected risks.
- Evacuation routes, supply recommendations, and emergency procedures should be verified against current local guidance and conditions.
- Medical information in your plan is based on what you provide and is not a substitute for professional medical advice.
7. Your Responsibilities
By using the Service, you agree to:
- Provide accurate, current, and complete information in the questionnaire.
- Review your generated plan and verify critical details (evacuation routes, emergency contacts, medical information) against your own knowledge.
- Not use the Service for any unlawful purpose or in violation of these Terms.
- Not attempt to reverse-engineer, scrape, or systematically extract content from the Service.
- Not share your account access with unauthorized individuals.
8. Intellectual Property
- The Service, including its design, branding, templates, and underlying technology, is owned by Prepared Hero and protected by intellectual property laws.
- Your generated plan is licensed to you for personal, non-commercial use. You may print, share with family members, and store copies for your household.
- You may not resell, redistribute, or commercially exploit generated plans or any part of the Service.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY EMERGENCY PLAN, RISK ASSESSMENT, EVACUATION ROUTE, OR OTHER CONTENT GENERATED BY THE SERVICE. EMERGENCY PREPAREDNESS PLANS ARE INFORMATIONAL TOOLS AND SHOULD NOT BE RELIED UPON AS YOUR SOLE SOURCE OF EMERGENCY GUIDANCE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREPARED HERO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM RELIANCE ON GENERATED PLAN CONTENT DURING AN ACTUAL EMERGENCY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Prepared Hero and its affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
12. Governing Law & Disputes
- These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
- Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
- You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
13. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property, disclaimers, limitation of liability, and indemnification.
14. Changes to These Terms
We may revise these Terms at any time by posting the updated version on this page and updating the “Last updated” date. Material changes will be communicated via email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
